Type of services provided

Following Cape Verde's accession to the WTO in July 2008, the objective of the project is to further support and facilitate Cape Verde's successful integration into the global regime by assisting the Government in the successful implementation of commitments made during the accession negotiations. Specifically, we assisted the Ministry of Economy, Growth and Competitiveness of Cape Verde in implementing action plans committed under the Accession Protocol on, among other issues, Customs, SPS, TRIPs and TBT. This meant support to WTO Task Force, participate in drafting legislations, and provide support to prepare the private sector to understand the new trade regime.

Our services included:

Component 1: Customs Issues

  • Training and capacity building of customs officials;

  • Preparation of comments on and recommendations for revision of Cape Verde's customs laws;

  • Hands-on assistance to WTO Task Force and customs authorities in the implementation of the Action Plan.

Component 2: Intellectual Property Rights and Copyright Issues

  • Review and revise both the Copyright Law and the draft Industrial Property Code in order to ensure their consistency with the WTO TRIPS Agreement and other international Conventions;

  • Support in negotiations with bilateral partners and drafting and review of agreements;

  • Design programs to strengthen capacity and institutional capability of Government agencies.

Component 3: Technical Barriers to Trade (TBT) and Sanitary and Phytosanitary Measures (SPS)

  • Preparation of comments on and recommendations for revision of Cape Verde's technical regulations in line with the WTO TBT and SPS Agreements (as well as with EPA). Assistance in developing a directory of legal texts on standardisation, quality assurance, accreditation and measurement (SQAM) issues;

  • Hands-on assistance to the WTO Task Force and SQAM bodies in the implementation of the Action Plan;

  • Training and capacity building: Evaluation of technical barriers to trade; Creation of a system of metrology, normalization, quantification, marking, labelling; Access to information on international trade, including the creation of a data bank on TBT; Regulation schedule and implementation timetable.

Component 4: Legal Issues

  • Support the Government, parliament and private sector in the review of current codes and in preparing revisions to commercial and investment codes, in line with the legislative action plan;

  • Review and drafting of laws;

  • Presenting and explain the new codes to key stakeholders (workshops).

Component 5: Market Access and Negotiation Issues

  • Assess impact of reduction of barriers to market access by Cape Verde (for trade in goods and services) and provide recommendations for reduction of barriers;

  • Assist in developing strategy for making use of market access opportunities generated by WTO accession;

  • Build capacity in trade negotiations, obtain market access, and enhance its managerial capacity to negotiate and monitor trade deals and exploit opportunities.
